Europe: Czech Government Decriminalizes Up To Five Pot Plants, 15 Grams

Beginning January 1, possession of up to 15 grams of marijuana or up to five marijuana plants will not be a punishable offense in the Czech Republic. Likewise, people will be able to possess up to 40 hallucinogenic mushrooms. The limits were announced Tuesday after they were decided on by the cabinet. Late last year, the Czech parliament approved a new penal code that specified no punishment for the possession of “small amounts” of drugs. But the code did not specify just what constituted a “small amount,” with the result that police sometimes charged people, especially home pot growers with more serious offenses. The task of formalizing those limits has been taken up by the Justice Ministry, which submits its proposals to the cabinet. The ministry has also proposed setting the “small amount” limits for ecstasy at four tablets and for hashish at five grams. Similarly, people could possess up to two grams of methamphetamine without fear of punishment. The cabinet will consider those proposals in two weeks. Possession of amounts greater than “small amounts,” but less than those assumed to indicate drug trafficking, will result of prison sentences of up to one year for marijuana and up to two years for other drugs. According to the European Monitoring Center for Drugs and Drug Addiction‘s latest annual report, Czechs are among Europe’s leading pot smokers. Among young Czechs (age 16 to 34), 22% toke up at least once a year. The European average was 16%.

The Staggering Incoherence of Drug Warrior Charles Grassley

Earlier this month, notorious drug war cheerleader Sen. Charles Grassley (R-IA) provoked outrage by attempting to censor debate about drug policy reform in Congress. He proposed an amendment that would literally ban a congressionally appointed expert panel from discussing legalization or decriminalization as part of a broad evaluation of criminal justice policies.

It's just a transparently pathetic strategy of defending the drug war status quo by outlawing meaningful debate and keeping alternatives off the table. Fortunately, just about everyone saw right through it. Pete Guither points out that Grassley is so cornered, he's now begging his constituents in Iowa to back him up on this. And the harder he tries to defend it, the weaker it sounds:

First and foremost, Congress ought to tackle issues whenever possible before bucking them to commissions. Increasingly, Congress is using commissions to avoid doing what Americans elect members to do: ask tough questions, identify possible answers, debate policy solutions and take a stand. Yeah, who needs experts when we've got politicians to make all our decisions for us?

This commission also would cost $14 million. It's hard to justify that expenditure in the current fiscal situation, especially when it's work that Congress should be doing itself.

Wait, so you can justify spending $50 billion a year on the war on drugs, but we can't justify $14 million to evaluate whether it makes any sense?

Finally, I put forward an amendment to address the issue of decriminalization and legalization of any controlled substance. I filed this amendment in an effort to start a debate on this important issue.


Really, Chuck? Really? How exactly does banning discussion of something promote debate? Everything, from the language of Grassley's amendment to his rich history of ignorant pro-drug-war posturing, proves what a total lie that is. The very essence of this controversy is that he blatantly attempted to prevent experts from looking into the issues he doesn’t want to talk about. Clearly, Grassley greatly underestimated the growing public demand for a new dialogue about our drug policies and got burned by his own arrogance, to such an extent that he is now hilariously masquerading as the champion of that critical discussion.  

The obvious bottom line here is that Grassley is consumed by his fear about what the experts will say. That is just implicit in all of this. If he wasn't deeply afraid of their conclusions, he wouldn’t be introducing amendments telling them what conclusions not to reach.  

The commission hasn’t even been appointed yet, so the very notion that it will become a referendum on the urgent need for sweeping reforms to our drug policy is purely a product of his paranoid imagination (combined perhaps with a subconscious recognition that the drug war is a gaping suckhole and smart people aren't exactly in love with it anymore). If Congress had named an expert panel consisting of Ethan Nadelmann, Rob Kampia, Jacob Sullum, Paul Armentano, Micah Daigle, Norm Stamper, Pete Guither and Willie Nelson, then maybe Charles Grassley could be forgiven for tearing from D.C. to Des Moines on horseback, flailing a dinner bell over his head and screaming that the legalizers are coming.  

Until that happens, the drug war pep squad would be well advised to just pipe down for the time being, lest their suggestions that we not discuss certain things should lead to yet more discussion of the things they don’t want discussed.

Outrage: Drug Warrior Congressman Tries to Prohibit Discussion of Legalization

Sen. Jim Webb (D-VA) has introduced legislation calling for a thorough evaluation of the U.S. criminal justice system, namely for the purpose of exploring ways to reduce our world-record prison population. As you might guess, simply discussing whether we should keep millions of American behind bars is enough to terrify the drug war's most committed champions.

They can’t handle the tough questions, so they're trying to make it illegal to even ask. Drug war hall-of-famer Sen. Charles Grassley (R-IA) today introduced an amendment to Webb's bill that would literally prohibit the commission from talking about legalization or even decriminalization:

AMENDMENT intended to be proposed by Mr. GRASSLEY
….
SEC. ll. RESTRICTIONS ON AUTHORITY.
The Commission shall have no authority to make findings related to current Federal, State, and local criminal justice policies and practices or reform recommendations that involve, support, or otherwise discuss the decriminalization of any offense under the Controlled Substances Act or the legalization of any controlled substance listed under the Controlled Substances Act.


These words are a legal blueprint for silencing all criticism of the war on drugs before the experts even get a chance to discuss it. The whole thing flagrantly violates the spirit of the entire inquiry and renders meaningless everything Webb is trying to do. And yes, that's exactly the point.

No one has done more than Charles Grassley to make the drug war into the horrible mess that it's become, so you can bet he'll do anything to protect his shameful legacy. If he succeeds, the bill will almost certainly end up protecting bad policies instead of exposing them. We can’t let that happen. A serious evaluation of criminal justice and drug policies is long overdue and that effort means nothing unless all options are debated openly.

Australia: West Australia Premier Vows to Roll Back Marijuana Reforms, Reenergize Drug War

Leading a Liberal-National Party coalition government, West Australia Premier Colin Barnett is introducing legislation this week to roll back reforms to the state's marijuana laws. Passed by an earlier Labor government in 2003, the changes decriminalized the possession of up to 30 grams of pot and allowed for the growing of up to two plants without fear of arrest and prosecution. In a media statement Sunday and another one Monday, the "tough on crime" premier gave clear notice he was cracking down on pot and other drug offenders, and was willing to extend police powers to do so. He said he would introduce legislation to repeal the state's Cannabis Control Act of 2003 and to amend the 1981 Misuse of Drugs and Youthful Offender Act. "The Liberal-National Government is committed to tackling both the demand and supply sides of the illicit drug problem through strong law enforcement policies, education and rehabilitation," Barnett said. "Cannabis is not a harmless or soft drug. Research continues to show that cannabis can lead to a host of health and mental health problems including schizophrenia, and can be a gateway to harder drugs," he maintained, treating highly controversial and discredited claims as if they were fact. According to Premier Barnett, his legislation will: • Prosecute those in possession of more than 10g of cannabis • See subsequent offences for possession being prosecuted as criminal offences. • Prosecute people for cultivating even one or two cannabis plants. • Extend the ban the sale of pot-smoking implements to minors to include everyone. • Increase the fine for selling smoking implements to $5,000 for sale to adults and $10,000 for sale to minors. Corporate entities could be fined up to five times those amounts. Barnett also wants to "reform" the Cannabis Infringement Notice Scheme (CIN), or ticketing and fines for decriminalized amounts by replacing it with a Cannabis Intervention Requirement Scheme (CIRS) that would require anyone ticketed to attend "drug education" classes. It would also mandate that anyone who failed to pay his fine would be prosecuted, something that has not been the case under the current law. Barnett's scheme would also allow for the criminal prosecution for marijuana possession of juveniles after two decrim tickets and adults after one. The current law has no such measures. There's more to come, Barnett promised. "The next steps will be to amend legislation to enable courts to impose a harsher sentence on dealers who sell or supply illicit drugs to children, irrespective of the location of the sale or supply," he said. "Further amendments to the Misuse of Drugs Act 1981 will provide offences for exposing children to harm or to the danger of serious harm from the manufacture of illegal drugs, such as amphetamines, or the unlawful cultivation of illegal hydroponically-grown plants. The Government will also move to ban the sale of drug paraphernalia, including cocaine kits." But, he said Monday, he's going to start by soon introducing legislation to allow police to stop and search anyone without probable cause. The police commissioner would designate certain "stop and search" zones with advance public notice, especially in entertainment areas. "Police will have the right to go up to anyone they wish to and introduce a stop and search power," Barnett said. "It will not be an invasive search; it will be comparable to the sort of search and screening that takes place for any citizen getting on an aeroplane."

Confused Drug Warrior Thinks Drugs Are Legal in Mexico

It's sad how often opposition to simple reforms is characterized by fundamental factual ignorance. Here's T. Michael Andrews, a former senior policy adviser at the Department of Homeland Security, freaking out about something that hasn't actually happened:

The thing is, drugs aren't legal in Mexico. They're just not. This isn't a matter of opinion. All they did was get rid of criminal penalties for possessing (not selling) very small amounts. It's usually referred to a decriminalization and even the U.N. is down with it.

It's possible, of course, that Andrews is merely trying to sensationalize the issue by conflating decriminalization with the more-controversial concept of legalization. But he straight-up insists that "Mexico will now become the vacation destination for all drug users," as though they're on the verge of opening coffeeshops for heroin.

I honestly doubt whether this guy even understands how Mexico's new drug law works, which means the Arizona Daily Star made a bad call by giving him a forum for complaining about it. You can send them a polite note by clicking here.

Argentine Supreme Court to Decriminalize Drug Possession Today

The Argentine Supreme Court is expected to issue a ruling decriminalizing drug possession for personal use today. The ruling will come in the case of five juveniles arrested with marijuana in the city of Rosario. The case has been under consideration by the high court for almost a year. The Argentine federal government has been reviewing its drug laws with an eye toward abandoning repressive policies toward users and is waiting for this case to be decided to move forward with new legislative proposals. Supreme Court Justice Carlos Fayt told the Buenos Aires Herald that the court had reached a unanimous position on decriminalization, but declined to provide further details. A positive Supreme Court decision on decriminalization would ratify a number of lower court decisions in recent years that have found that the use and possession of drugs without causing harm to others should not be a criminal offense.

Hello? Mexico on the Verge on Decriminalizing Drug Possession...

...and nobody north of the Rio Grande seems to have noticed. Last week, I wrote that the Mexican decrim bill had passed the Senate, but on the afternoon before we published that report, the bill also passed the Chamber of Deputies. Now it awaits only the signature of President Calderon. While a Dallas Morning News blogger wrote that it is unclear whether Calderon will sign the bill, it seems likely to me that he will. The bill, after all, was pushed by his ruling PAN party, and unlike 2006, when a similar bill passed only to be vetoed by then President Fox in the face of US threats and bluster, there have been no threats and bluster from Washington this time. And, of course, the situation in Mexico is much worse than in 2006, thanks largely to Calderon's war on the cartels. The bill is not great: The personal use quantities are tiny, and it allows for the states to prosecute low-level trafficking offenses (currently, that is the province of the feds, with the result being that being low-level traffickers are never tried because the federal prosecutors and courts are overwhelmed with serious trafficking cases). But it is decriminalization, and right on our border, not an ocean away, like Portugal. I'll be talking to people on both sides of the border this week about this bill and what it means and I'll have a feature article on it Friday. The lower house of deputies passed the bill late on Thursday. It already has been approved by the Senate and is expected to be signed into law by Calderon in the days ahead. Mexico's Congress passed a similar proposal in 2006 but the bill was vetoed by Calderon's predecessor, Vicente Fox, after Washington said it would increase drug abuse. The United States recently pledged stronger backing for Calderon's army-led war on drug cartels, whose turf wars have killed some 2,000 people so far this year in Mexico, as the drug violence is starting to seep over the border. The new bill also allows Mexican states to convict small-time drug dealers, no longer making it a federal crime to peddle narcotics, a move that should speed up those cases. U.S. President Barack Obama praised Calderon's drug war efforts in a visit to Mexico last month and promised more agents and southbound border controls to curb the flow of guns and cash to the cartels. Mexican Senate Votes to Decriminalize Drug Possession

Good news from Mexico:

MEXICO CITY, April 28 (Reuters) - Mexico's Senate approved a bill on Tuesday decriminalizing possession of small amounts of narcotics for personal use, in order to free resources to fight violent drug cartels.

The bill, proposed by conservative President Felipe Calderon, would make it legal to carry up to 5 grams (0.18 ounces) of marijuana, 500 milligrams (0.018 ounces) of cocaine and tiny quantities of other drugs such as heroin and methamphetamines.

Mexico's Congress passed a similar proposal in 2006 but the bill was vetoed by Calderon's predecessor Vicente Fox, under pressure from the United States, which said it would increase drug abuse, but now is worried by the drug-related violence along its border. [Reuters]

These are pathetically small amounts of drugs, but seeing any type of drug policy reform happening in Mexico is a positive development. When decriminalizing drug possession to help focus on the cartels doesn't work, maybe we can finally start talking about legalizing drugs to de-fund and destroy the cartels entirely.

Breaking News: Massachusetts Has Not Been Taken Over by Drug Maniacs

I visited Boston this weekend for the Northeast Regional SSDP Conference and was curious to observe that no one was smoking marijuana on the sidewalks. Weird, huh? It's been months now since Massachusetts decriminalized small-time marijuana possession and yet it almost felt as though I wasn't surrounded by hippies in a skunky smoldering ashtray from hell.

Good thing I kept the receipt for that gasmask. This is great news for everyone, especially all the police officials who were genuinely concerned that life in Massachusetts would be at least partially destroyed if the punishment for marijuana was reduced slightly.

Those cops must really be glad that no one listened to them and everything worked out this way, because now we've got the best of both worlds: 1) fewer people have their lives messed up by getting a criminal record for pot, and 2) nobody blows bong hits in your face when you're trying to hail a taxicab.

It's really beautiful to see that the collective goodness of mankind can somehow prevent an intoxicating plant from utterly destroying the world.

Decriminalization is a Huge Success in Portugal

On Friday, I had the opportunity to hear Glenn Greenwald speak at the Cato Institute regarding his Cato-sponsored report, Drug Decriminalization in Portugal: Lessons for Creating Fair and Successful Drug Policies. You can read the report here and Cato also has a downloadable MP3 of the event.

The back-story here is that Portugal implemented an across-the-board drug decriminalization policy back in 2001. There's been very little discussion and research regarding its impact, hence Cato recruited Greenwald (a genius and extremely popular political blogger) to study Portuguese drug policy. His findings thoroughly illustrate the efficiency of decriminalization towards addressing key drug policy goals, while refuting the myth that removing harsh penalties will lead to increased consumption.

The whole thing utterly shatters most, if not all, arguments that continue to be advanced in support of tough drug laws here in the U.S. and around the world. I found a couple points particularly interesting:

1. When Portugal began looking at alternative policies to address  a growing drug problem, they did not consider legalization because it was determined that such a policy would violate international treaties. It's a small country that can't afford to be belligerant. This just goes to show, once again, the extent to which prohibition is not a consensus policy at the international level, but rather an idealogical approach that less powerful nations have been forced to accept.

2. The decision to implement a decriminalization policy emerged through discussion of empirical data, rather than emotional arguments about morals, civil liberties and so forth. I don't know how representative this is of what approach would be most effective in establishing more reasonable policies here in the U.S., but it's certainly worth taking a look at the context in which decriminalization triumphed over other policy options.
