Fixing Our Criminal Justice System Isn’t Political Suicide. Stop Saying That.

Washington Post has a whole story on Virginia Senator Jim Webb’s thoroughly awesome ideas about criminal justice reform:

This spring, Webb (D-Va.) plans to introduce legislation on a long-standing passion of his: reforming the U.S. prison system. Jails teem with young black men who later struggle to rejoin society, he says. Drug addicts and the mentally ill take up cells that would be better used for violent criminals. And politicians have failed to address this costly problem for fear of being labeled "soft on crime."

Webb aims much of his criticism at enforcement efforts that he says too often target low-level drug offenders and parole violators, rather than those who perpetrate violence, such as gang members. He also blames policies that strip felons of citizenship rights and can hinder their chances of finding a job after release. He says he believes society can be made safer while making the system more humane and cost-effective.

Sadly, one rarely hears a Washington lawmaker talk about our drug policy priorities in a way that makes any sense. So, fittingly, Washington Post dedicates plenty of space to the theory that Jim Webb’s gonna get massacred for his crazy blasphemous ideas:

"It is a gamble for Webb, a fiery and cerebral Democrat from a staunchly law-and-order state."

"…as the country struggles with two wars overseas and an ailing economy, overflowing prisons are the last thing on many lawmakers' minds."

"…Webb has never been one to rely on polls or political indicators to guide his way."

"Some say Webb's go-it-alone approach could come back to haunt him."

No, it won’t. Just watch as that completely fails to happen. Recent polls show that democrats and republicans agree the drug war has failed and that is just a fact. Too bad it’s fact that completely eluded The Post throughout a lengthy article about the politics of criminal justice reform. They found room to postulate endlessly about the supposedly disastrous political consequences of saying anything bad about our policies, but they couldn’t find a single line to show what the public actually believes.

Of course, to include actual relevant polling data would refute a central point of the article: that there’s something really mavericky and even reckless about Webb’s ideas. There isn’t. Those same ideas didn’t stop Obama from winning Virginia, so this whole political-suicide-by-drug-policy-reform narrative is garbage. Stop trying to recycle it. Just put it where it belongs.

How Much More Public Support Does Medical Marijuana Really Need?

CNN hosted an interview with House Speaker Nancy Pelosi on Wednesday which featured democratically elected questions courtesy of the popular website Digg.com. Unsurprisingly, one of the top questions was about marijuana policy reform. Here is her response (it’s the 3rd question):



Obviously, Pelosi is very supportive of medical marijuana and despite her pessimism about achieving full-scale legalization, she didn’t actually say she opposed it. Ideologically, I’d have to say this was pretty good coming from the Speaker of the House. But, as Paul Armentano points out, Pelosi’s advice to supporters of medical marijuana just doesn’t add up. She laments Congress’ intransigence on the issue and encourages constituents to contact their representatives, as though this is all just a matter of showing politicians where the people stand.

Alas, we kinda tried that already. Public support for medical marijuana has been overwhelming for a long time. Reformers are 9-1 when it comes to passing state-level medical marijuana laws at the ballot box. State legislatures in Hawaii, New Mexico and Rhode Island have passed laws to protect patients, drawing praise from constituents. The only memorable instance of a politician being damaged for his position on medical marijuana involved Bob Barr, who lost his House seat following attacks for opposing medical marijuana. He’s come around since then.

What, other than legalizing medical marijuana in a dozen states, could the people possibly do to show the politicians in Washington, D.C. that we’re serious about this? You want us to go legalize medical marijuana everywhere else in America? We’ll do it. You want more research proving that it works? Let us know when you’re done reading what we’ve already given you, and we’ll gladly send the rest. Worried about the message to young people? Teenage use is down in states with medical marijuana laws.

You see, our feet are tired. Our throats are hoarse. Our keyboards are cracking, our sharpies are dry and we’re almost out of posterboard. With all of that in mind, Nancy Pelosi, since you do agree with us and you’re the Speaker of House now, we were hoping there might be something else you could do.

Hey, Dirtbags, Ya Wanna Know What Cops Think About Frank's Decrim Bill (and You)?

Pot smokers and drug reformers weren't the only people interested in Barney Frank's news conference yesterday about his decriminalization bill. The law enforcement web site Police 1 noted it as well and posted a short piece asking its readership what they thought. The piece, Are Small Pot Busts Taking Cops Away From Important Work? What Do You Think?, was a calm, unbiased look at the decrim bill and what it would (and wouldn't) do. I wish I could say the same about the responses. Now, before I get into the meat of the matter, I would be remiss if I didn't point out that the responses are not necessarily reflective of police officers' views in general, but are only the responses of a self-selected set of anonymous posters who have registered with Police 1 and who Police 1 says are verifiably law enforcement personnel. That caveat notwithstanding, the posters offer a pretty depressing look into the mind-set of at least some cops. Here are some of them:
Raymundo: I think we all know that pot heads just want to be able to do what they want. Marijuana kills brain cells and they don't come back, hello we need those. Marijuana should stay illegal and I hope congress continues to see that it should be illegal.
SPD853: I think we waste time on plenty of crimes. It is our job. Those cops who think it is a waste of time just "wind test" it anyway (if they do anything at all).
I hadn't heard the phrase "wind test" before. I think that means when they just steal your property, open up the baggie and let the goodies blow away in the wind. That's pretty rude, but preferable to getting arrested, I guess.
Chr1s11: How many of those "small" pot busts have been turned over for info leading to a much larger bust for a much worse controlled substance. The pot heads tend to give up the crack dealer to save the misdemeanor record. Besides, it's still an illegal substance that causes serious dificulty for someone to be a productive individual. Pot heads are the loosers that turn into coke/crack/meth heads. Then comes the violent crime they have to commit to support the habbit.
Well, of course. We all know that pot smokers are crack heads who inevitably turn to violent crime to support their habits. The only other comment I have on this poster is that anyone who can't spell loser correctly probably shouldn't be calling other people losers. He would be better off going back to school and actually passing eighth grade this time.
Baltoblue: I'd rather lock people up for Marijuana all day long then taking 6 reports a day because people can't resolve small problems on their own. The fact is that people can't resolve small problems on their own. The fact is that Marijuana is great PC for searching vehicles (on smell), and also leads to larger cases. I for one, have never locked up a nuerosurgeon for pot, and most that I lock up for pot are involved in larger crimes.
A couple of things on this one: I know I shouldn't pick on people for misspellings, but when you're trying to call pot smokers dumb, you should probably spell "neurosurgeon" correctly. Secondly, Baltoblue's point that pot is great for providing PC (probable cause) for searching cars is a common theme on this board.
Mac25: It is already hard enough to get a conviction when they wont emit it is their property but now they will say it is for personal use and I am not selling. When you compare the drugs (marijuana/alcohol) they both have their down falls but seem to be the lesser evil of all the drugs out there. With that said, the battle on drugs including marijuana has gone on too long to turn around and try to make it legal. I would say most, at least 75, of the people that use marijuana are dirt bags and are involved in other crimes or some how connected to those that commit the crimes. The marijuana arrests are and can be used to assist us (police) in catching those criminals. If it is legalized it will be thrown in our faces day in and day out by these criminals.
This guy's reasoning skills are right up there with his spelling and composition skills. So, 75 (percent, I assume, unless he's personally counting up the dirt bags) of pot smokers are "dirt bags" and are involved in other crimes or know somebody involved in other crimes or live in the same country as people committing other crimes or something. But at least there was one poster who was sympathetic:
In 14 years of active road service as a cop, I have never responded to a call involving anyone who had smoked a joint and was ready to fight with their wife or anyone else for that matter. Yes, I think to much time is spent on arrests involving small amounts of pot. Alcohol, on the other hand, has cost our country Billions of dollars and a tremendous loss of life. While I don't think pot should be legal, I think we need to re-think this issue.
There are more comments on the web site. Check 'em out if you have the stomach for seeing what those people who are supposed to serve and protect you think about you. As for me, I always try to treat police officers with the same respect they show me.

Congressional Black Caucus Members Try to Ban Menthol Cigarettes

Uh-oh. They're trying to take our minty-fresh menthols away. Not kool.

The Congressional Black Caucus is calling for changes to a House tobacco-regulation bill, demanding that the legislation place restrictions on menthol cigarettes, the type heavily favored by African-American smokers.

The 43-member caucus is taking aim at a provision in the bill that would ban candy-, fruit- and spice-flavored cigarettes but that specifically exempts menthol. In recent weeks the exemption has become the focus of controversy because menthol brands are heavily used by black smokers, who develop a large share of smoking-related cancers and other health risks. The menthol prohibitionists' argument is simple: if black people are more likely to smoke menthol + black people are more likely to get lung cancer = menthol increases lung cancer risk. Of course, it's possible that black folks are just more susceptible to lung cancer for some horrible reason, but I guess the Congressional Black Caucus thinks the quickest way to find that out is to ban Newports™ and see if black people live longer. I disagree. I think the best way is to check whether the 25% of black smokers who don't smoke menthol have the same lung cancer rates as those who do.

Either way, banning menthol cigarettes is drug prohibition and we know what that leads to:

Some supporters of the bill’s current language on menthol have argued that, because menthol is widely used by many smokers, the effects of banning it outright are hard to predict. Among possibilities they have suggested is that menthol smokers would turn to an illicit cigarette market to obtain menthol cigarettes.

If nothing else, such a policy may rain hell on one of the Congressional Black Caucus' other legislative priorities: ending racial profiling. "Sir, do you have anything in the vehicle I should know about? Drugs? Weapons? Menthol cigarettes?"

Barney Frank Introduces Marijuana Decriminalization Bill

"The Personal Use of Marijuana by Responsible Adults Act of 2008," introduced by Congressman Barney Frank (D-Mass.), would eliminate the threat of arrest and prison for the possession of up to 3.5 ounces of marijuana and/or the not-for-profit transfer of up to one ounce of marijuana. It would not affect federal laws prohibiting selling marijuana for profit, importing and exporting marijuana, or cultivating marijuana. It also would not affect any state or local laws and regulations.

Because almost all marijuana arrests are made by local and state police, the primary impact of this federal bill is twofold: First, it would offer protection to people who are apprehended with marijuana in federal buildings or on federal land (such as national parks); and, second, the bill sends a message to state governments that the federal government is now open to the notion of states reducing their marijuana penalties, too.

This historic legislation comes 36 years after the National Commission on Marihuana and Drug Abuse made a similar recommendation to President Richard Nixon, suggesting that he decriminalize small amounts of marijuana.
Congress can send the right message by passing this bill and demonstrating its commitment to defending individual freedom, while focusing federal law-enforcement resources on real crimes. As Barney Frank argues:
"I do not believe that the federal government should treat adults who choose to smoke marijuana as criminals. Federal law enforcement is a serious business, and we should be concentrating our efforts in this regard on measures that truly protect the public."
Despite bi-partisan co-sponsorship (Ron Paul, of course), I'm kinda not expecting this thing to become law anytime soon, but it will be fun to see who our friends are. Any debate over the bill will just reveal the idiocy of those in Congress who want federal law enforcement agents busting hippies for half-eighths, instead of defending the homeland from terrorists, zombies, and dancing libertarians.

Let it be known that one can stand for sensible drug policy without being voted out of Congress.

Good Guys, Bad Guys: Bills Filed to Improve or Worsen Crack Cocaine Sentencing

There are "good guys" and "bad guys" in Congress. More accurately, perhaps, there are members of Congress who do good things at least some of the time, and members of Congress who do bad things some of the time. Among the latest good guys are Rep. Sheila Jackson-Lee, Democrat of Texas, and 32 cosponsors of her bill H.R. 4545, the "Drug Sentencing Reform and Cocaine Kingpin Trafficking Act of 2007," introduced 12/13. H.R. 4545 would ameliorate some of the atrocity that is federal mandatory minimum sentencing by reducing crack cocaine penalties to equal those existing for powder cocaine. The Supreme Court ruling and the Sentencing Commission recommendations that came down recently don't help with the mandatory minimums, but only help with sentencing guidelines cases. The bill also includes language intended to focus federal drug enforcement activity on high-level players instead of small-timers as they do now. One of the latest bad guys is Rep. Lamar Smith, Republican also of Texas, the sponsor of H.R. 4842, introduced 12/19, a nasty bill to reverse the Sentencing Commission's positive ruling in favor of making the recent crack sentencing reductions retroactive. Smith only has eight cosponsors, as compared with Jackson-Lee's 32, and Jackson-Lee has the chairman of the subcommittee of Judiciary that would consider it, Bobby Scott (D-VA). I don't see John Conyers (D-MI) on there yet, the chairman of the Judiciary Committee itself, but he's just as much on our side as Scott is. I don't think Smith has much of a chance on this one, but you never know. Jackson-Lee has been a strong support of our efforts repealing the Higher Education Act's drug provision, and spoke at our 2005 press conference:

Is Rep. Dana Rohrabacher a Legalizer?

Does US Rep. Dana Rohrabacher (R-CA) favor drug legalization? He didn't directly say so, and putting words into people's mouths is a good way to wind up being wrong a lot of the time. Still, the following remarks, pointed out to me (again) by DPA's Grant Smith, seem more than a little suggestive of exactly that. From the Congressional Record, page H14135:
THE 75TH ANNIVERSARY OF THE END OF PROHIBITION The SPEAKER pro tempore. Under a previous order of the House, the gentleman from California (Mr. ROHRABACHER) is recognized for 5 minutes. Mr. ROHRABACHER. Madam Speaker, December 5, 1933, December 5, 2007. So, tomorrow we mark the 75th anniversary of something, and most people will just pass it by and not be aware that tomorrow marks the end of America’s great and noble experiment. It is the 75th anniversary of the end of the national prohibition of alcoholic beverages. With the repeal of prohibition in 1933, that was 75 years ago tomorrow, the United States ended a social planning policy that created organized crime in America, crowded our jails with nonviolent prisoners, corrupted our police, increased urban violence, and destroyed the lives of thousands of victims of unadulterated and poisoned substances, substances which if they were permitted would have been subject to normal market protections of fraud and quality standards. However, during prohibition, these substances which were consumed by the American people often poisoned them and caused them to lose their lives. Philosopher Santayana told us that those who cannot learn from history are doomed to repeat it. Have we in Washington learned the lesson of prohibition that ended 75 years ago? Why did America reject the prohibition of alcoholic beverages? Well, when government attempts to control the peaceful behavior of its citizens, it often sets in motion forces that are more dangerous than the social evil that they are trying to control. Today’s war on drugs is perhaps an example. The war on drugs has resulted in a multimillion dollar network of violent organized crime. The war on drugs has created the deaths by drive-by shootings and turf wars among gangs in our cities. The war on drugs has overcrowded our prisons. More than half of Federal prison space is occupied by nonviolent drug users. The war on drugs has corrupted our police and crowded our courts. We apparently did not learn the lesson of the prohibition of alcoholic beverages. Today, on the campaign trail we hear new calls for prohibitions on cigarettes, on fatty foods, and even more money should be spent, yes, on the war on drugs. But, as we mark the 75th anniversary of the repeal of prohibition, let us have the courage to learn from the mistakes of the past. Perhaps it would be better for us to focus our energies not on the supply side of drugs just as they were doing with the supply side of alcohol, but instead to focus our efforts on trying to help those people who are addicted to drugs; perhaps to try to help our young people, deter our young people from getting involved in drugs; perhaps to take a whole new approach on this, rather than this monstrous war on drugs that has done nothing but create havoc in our inner cities, making so many young people who have been arrested and their lives destroyed because they will never be able to get a decent job after one arrest being a teenager. So many people have been hurt by the war on drugs; yet we keep it because we want to supposedly help people. Well, I would suggest that this 75th anniversary of the repeal of prohibition, which was the greatest failure of American social planning in the history of our country, let us try to commit ourselves to help ensure that our young people are dissuaded and deterred from the use of narcotics. Let us work with those who are, indeed, addicted to narcotics and help them free themselves from this habit. But let’s end this notion that we can try to control the use of narcotics in our country by simply controlling the supply. Simply controlling the supply will not work. We’ve got to look at the demand side, try to treat people humanely, and use the limited resources that we have in a much more constructive way, rather than just creating more police who are committed to drugs and interdiction and all the rest of the major expenses, court expenses and others that go into a war on drugs rather than an attempt to help people who are susceptible to the use of drugs. I call the attention of my fellow colleagues to this the 75th anniversary of the repeal of the prohibition of alcoholic beverages.

Needle Exchange Action May Be Imminent

Last spring at the National African American Drug Policy Coalition summit here in Washington, the question was asked of Donna Christian-Christensen (Congressional Delegate from Guam, the closest thing the territories have to US Representatives), a physician and chair of the Congressional Black Caucus’ Health Braintrust, what the prospects were for repealing the ban on use of federal AIDS grant funds to support needle exchange. Her answer was, "We're going to give it a good try." I took that to mean "it's not going to happen this time." The issue has made some progress however, at least as it affects us here in the District of Columbia, where a particularly infamous part of the annual appropriations bill prevents DC from spending even its own locally-collected tax funds on needle exchange appears to be on its way to getting repealed, thanks to positive action by a House subcommittee that drafted the new appropriations bill. I know better than to take it as a given that repeal will make it all the way through. But it is looking pretty good, and at the PreventionWorks! anniversary party this evening -- attended by new PW executive director Ken Vail -- AIDS Action lobbyist Bill McColl informed the crowd that it could hit the floor within a few days. Earlier this year we reported that Hillary Clinton was noncommittal about lifting the ban during a videotaped exchange at a private forum with prominent AIDS activists. The exchange was fascinating; after several pointed back-and-forths with Housing Works executive director Charles King, Sen. Clinton directly acknowledged that it was political concerns only that accounted for her position (though the kinds of concerns that can't necessarily be dismissed offhand). Sen. Obama, by contrast, had stated his support for lifting the ban. This week Clinton took the plunge and made strong pro-needle exchange promises in a campaign statement on AIDS funding. What would ultimately happen with this in a Clinton presidency, or any Democratic presidency, is probably hard to predict -- politics is still politics. But the fact that the Democratic candidates are lining up to support the issue has McColl feeling cautiously optimistic that the Democratic Congress won't drop the ball on the DC language at least. And it's encouraging for all of us about the long-term. The federal needle exchange restriction came to a boil during the Clinton administration, when the findings needed to lift the ban -- needle exchange doesn't increase drug use, but does reduce the spread of HIV -- were made by the administration, but not acted on. Some advocates believe that if Donna Shalala had been on a certain Air Force One flight, instead of Barry McCaffrey, that it would have happened. It took a change in Congress to even get the issue back onto the radar screen; more may be needed to actually get the law changed. Still, let's keep our fingers crossed for the DC ban to be lifted, maybe even by the end of the year. Assuming that happens: Let's Do Heroin! (That was sarcasm, in case anyone didn't realize.)

Drug War to Figure Prominently in Sen. Webb's Incarceration Hearing Tomorrow -- Available by Webcast

The state of Virginia has not traditionally been in the vanguard of criminal justice reform -- maybe the other way around -- but it does have some political figures who are enlightened on such issues. Rep. Bobby Scott of Richmond is one who has played a leading role in fighting this good fight for many years. Now, Virginia has Sen. Jim Webb. Last March we reported on remarks he had made on ABC about how mass incarceration is tearing the country apart and those are the kinds of issues he wants to work on. He's coming through. Tomorrow is Webb's first public hearing on the issue, "Mass Incarceration in the United States: At What Cost?" At the time of this writing, it is the top news link and prominently displayed on Webb's Senate home page. Follow the links from there and you'll find a lot of the things we've been saying for years, about incarceration in general and the drug war in particular. We've heard that at least one of the speakers is going to call for an end to the drug war. The venue where this is taking place is the Joint Economic Committee, comprised of members of both the Senate and House. New York's Chuck Schumer is the top Democrat on the committee, an influential figure in criminal justice policy. It's hard to tell in advance, but this feels like it could be a significant turning point, even if like most hearings it is likely to be a quiet one. Important Criminal Justice Hearings Coming Up in Senate

I've been hearing about this from one of our members who has a son in prison, and now it's been discussed in the Boston Globe: Sen. Jim Webb is holding hearings on October 4th dealing with the economic impact of incarceration. Webb crossed our radar screen last March when he remarked on George Stephanopoulos' program that mass incarceration is "tearing this country apart." Check out Life Sentence, a column published in the Globe Sunday by Christopher Shea, which uses the hearings as a hook to examine the issue and highlight works by some important scholars. There's a discussion taking place on the comment board too that you can join.
