Statewide Legislative Update

On Monday, March 22, the Colorado House Judiciary Committee passed HB 1284, which will now continue to wind its way through the state house.  Thanks to pressure from Sensible Colorado and other activists, HB 1284 is in better shape and does not include a number of onerous provision including local dispensary bans and limits on where patients can live (i.e. near schools).  An updated version of this bill is available here. 

However, our fight is not over.  This bill still has a number of provisions which hinder safe access for patients, and we will continue to monitor and influence this bill moving forward.  Please consider supporting our important work by becoming a monthly donor today.

Finally, despite hearing from many concerned citizens, the provision which would have allowed veterans and other victims of Post Traumatic Stress Disorder (PTSD) to access medical marijuana, lost by one vote.  You can read an overview of this vote, with a quote from Sensible's Brian Vicente blasting the Health Department's opposition to this amendment here.

Legislative Update: PTSD and Veterans

Legislative Update:  Increase access to medical marijuana for Veterans!  Vote on Monday.

 

Legislative Update:  HB 1284-- which seeks to regulate dispensaries-- will be voted on in the House Judiciary Committee on Monday, March 22 at 1:30pm.  No public testimony will be allowed at this Hearing.  However, it is important that the Committee members hear from advocates in advance of the vote. 

Please call or email these legislators and ask them to:

(1) Keep patients needs in mind!  Don't restrict where patients can live or force them to give up their right to grow, if they choose to designate a caregiver.

(2)  Don't let cities ban dispensaries!  Patients get sick in all corners of Colorado and dispensaries should be allowed to service patients in their home communities.

(3)  Let Veterans with PTSD have access to medical marijuana!  Every month at Sensible's office we hear from dozens of Vets and other traumatized citizens who could benefit from medical marijuana.  On Monday, Rep. Sal Pace will offer an amendment to allow these disabled individuals to have access to medical marijuana for their diagnosed PTSD.  Please thank Rep. Pace and urge other Committee members to vote "yes" on this amendment!

Dear friends:

Freedom of speech is an invaluable and fundamental element of democracy, and LEAP's speakers are committed to speaking out about their personal experiences serving in the "war on drugs."  Recently, active duty Canadian police officer and LEAP speaker David Bratzer was scheduled to speak on a panel at a City of Victoria harm reduction forum.  Victoria Police Department leadership intervened, ordering Bratzer not to speak at the forum. 

Constable Bratzer has spoken policy about drug policy on many occasions, including a Senate Committee meeting in Ottawa.  He speaks on his own time, out of uniform, and always clearly states that his views do not reflect those of the Victoria Police Department, but the department said people would be "confused" if Bratzer were to speak on an issue of public policy at the forum. 

The criticism of harmful and ineffective drug policy by the law enforcement professionals tasked with upholding these policies serves the public interest.  It is crucial to protect the rights of law enforcers to publicly express their views on drug prohibition, especially in relation to harm reduction.  If you believe censorship is unfair, please visit

Slowly, Limits On Pot Are Fading


USA Today speaks to Judge Jim Gray in a front-page feature article

James Gray once saw himself as a drug warrior, a former federal prosecutor and county judge who sent people to prison for dealing pot and other drug offenses.  Gradually, though, he became convinced that the ban on marijuana was making it more accessible to young people, not less. 

"I ask kids all the time, and they'll tell you it is easier to get marijuana than a six-pack of beer because that is controlled by the government," he said, noting that drug dealers don't ask for IDs or honor minimum age requirements. 

So Gray -- who spent two decades as a superior court judge in Orange County, Calif., and once ran for Congress as a Republican -- switched sides in the war on drugs, becoming an advocate for legalizing marijuana.

Fighting a Losing Battle

After 20 years in law enforcement, Peter Christ is familiar with the war on drugs.
Christ said as a police officer, drug arrests were the only arrests that made no difference to his community. When the media speaks of drug-related violence, he said, what's really happening is money-related violence. Eliminate one kingpin of the drug trade in a certain area and violence escalates until a new one is found, he said.

"It's a failed policy," he said. "You arrest one, but the market is so big and there's so much money there that their spot gets filled quick."

Christ pointed out that even prisons are not drug-free. He said the war on drugs is simply another word for prohibition, and because of free choice, prohibition simply does not work.

"If people want to do something, they're going to find a way to do it," he said. "If we can't even keep drugs out of prison, how can we keep them out of a free society?"

The American Prospect speaks to Norm Stamper

The Prospect asked LEAP member and former Seattle police chief Norm Stamper a few questions about liberalizing drug policy, K2, and what fake pot suggests about a misguided war on drugs.

When people think about police chiefs, liberalization of drug policy is probably not the first thing that jumps to mind. So why are you against drug prohibition, and what prompted you to join LEAP?

My first epiphany was back when I was a rookie beat cop back in San Diego. I had arrested a 19-year-old, a young man who was in possession of marijuana, not a saleable amount, in his own home. But given the circumstances, I kicked in his door, I chased him to his toilet, I scooped up a handful of soggy seeds and stems and a few leaves. And I took him to jail.

On the way to jail, he's sitting in the backseat, and I'm thinking, "My God, I could be doing real police work." And it kind of hit me like a ton of bricks. I'm going to spend a couple hours, minimum, writing case reports, an arrest report, impounding the pot, and booking him into jail. . .

Remembering Jerry Paradis

We are all saddened to say goodbye to Law Enforcement Against Prohibition board member Judge Jerry Paradis, who passed recently from cancer. Jerry's rare combination of expertise and compassion will be impossible to replace.

Having presided over 1,000 drug-related cases in the Provincial Court of British Columbia before his retirement in 2003, he came to realize that drug policy, not simple drug use, was responsible for so much unnecessary death, disease, crime and addiction. Working within the constraints of the legal system he was able to combine his sensible, empathetic side with the intellectual rigors of jurisprudence.

Above all, Jerry was a kind, thoughtful and supportive friend. He had a wonderful, down to earth quality that made people gravitate to him and respect his judgment. He played a pivotal role in stabilizing LEAP and helping it to remain vibrant.

He will be missed.

D.C. Holds Hearing on Medical Marijuana

ASA testifies on behalf of patients

Local officials in Washington, D.C. are shaping legislation to make medical marijuana available to patients there, after Congress lifted a ban on implementing a 1998 initiative in the District.

D.C. resident and Executive Director of Americans for Safe Access Steph Sherer was among the patients and advocates who appeared before the council at a hearing this month to explain why they should use care in restricting access to medical marijuana.

"A lot of regulations look good on paper but don't really help patients," Sherer told the members of the council's judiciary and public health committees. She urged the council not to limit patients to receiving recommendations only from their primary care physicians, explaining that chronically ill patients frequently see many specialists, and those that specialize in cannabis therapies are no different.

The D.C. council is wrestling with regulatory amendments for implementing Initiative 59, which was approved directly by District voters. In addition to restrictions on who can write recommendations for medical cannabis, officials are considering limiting what conditions patients could be treated for, who will be permitted to work in dispensaries, and where the cannabis would be cultivated.

Officials have said they are concerned because any legislative action taken by the council must be approved by Congress. Council Chairman Vincent Gray co-introduced the proposed legislation with council members David Catania and Phil Mendelson.

"This is a great first step, and we are confident that after hearing from patients in the District, the Council will make the necessary improvements," said Sherer.

Maryland May Be 15th Medical Cannabis State

Advocates and patients testify before state lawmakers

Patients and advocates testified before Maryland state legislators this month in support of new legislation to make medical marijuana legal in the state. The hearings of the House Judiciary Committee and Health and Government Operations Committee addressed concerns about the proposed law's restrictions.

"We applaud the Maryland legislature for recognizing the need to protect medical marijuana patients," said Caren Woodson, ASA Government Affairs Director. "But this bill falls short of meeting the fundamental needs of patients."

The proposed measure -- HB712, introduced by Maryland House Delegate Dan Morhaim, M.D. -- would replace the state's current medical marijuana law, the Darrel Putnam Compassionate Use Act, which was adopted in 2003. Existing law provides for patients who use and possess cannabis for medical treatment to receive misdemeanor convictions with maximum fines of $100.

The new legislation would put the state's health department in charge of the medical marijuana program, including the licensing of patients, caregivers, large-scale growers, and distributors. Patients would b e prohibited from cultivating any cannabis themselves and could only legally possess two ounces or less of medicine.

European Coalition for Just and Effective Drug Policies -- March 2010 Bulletin

ENCOD BULLETIN ON DRUG POLICIES IN EUROPE MARCH 2010 "CLOSER TO THE TRUTH" From March 8th to 12th, 2010, the UN Commission on Narcotic Drugs will hold its annual meeting in Vienna, to evaluate the results of the current drug control strategy. The stated goal of this strategy is to reduce the production, trade and demand for illegal drugs. The truth is, that there are no positive results of this strategy at all. On February 23, 2010, during the Public Hearing on EU Drug Policies that Encod co-organised in the European Parliament, Carel Edwards, the Head of the Drugs Coordination Unit of the European Commission stated that: "Repression does not work. We know enough now to draw this conclusion." Since March 2009, the European Commission has had in its possession a report on the impact of drug policies on the Global Market of Illicit Drugs from 1998 to 2007. This report draws the following conclusion: current drug policies, based on prohibition, fail to diminish drug supply and demand and are causing harm to individuals and society at large. An ENCOD delegation will also be present at the coming meeting in Vienna, to remind government delegates that they are there to protect their people against dangers, not to expose them to these dangers. On March 4, Encod members will organise a protest at the Embassy of Malaysia both in Paris and London. The same day a public letter to the Malaysian government will be published in the Malaysian press in order to ask for an immediate end to the death penalty for drug offenders. The truth of the statement we have made for many years, that prohibition is the real menace for society, is becoming as evident as the fact that the sun rises every day. Drug prohibition results in immense illegal profits, perturbing the economy, corrupting authorities and fueling armed groups. It causes and increases social exclusion and individual stress. The total public expenditure needed to maintain drug prohibition just in the EU is estimated (conservatively) at 40 billion Euros, or 80 Euros per citizen per year. In times of economic crisis we can no longer allow such an amount to be wasted on a policy that clearly has no benefit whatsoever, and at the same time generates problems and harm for millions of individuals. The Reuter Trautmann report also exposes these truths. Those who accept scientific evidence can no longer deny that drug prohibition has been proved a false theory. A framework for the legal production and distribution of drugs is the only reasonable and effective way to reduce drug related problems, reduce organised crime and raise tax revenues to invest in health, education and social programmes. The question is not if, but when. To accelerate the end of prohibition, we must continue with determination to fulfill two objectives: discredit the prohibitionist regime, ensuring it has no way to rejuvenate itself, and encourage people who want another policy to speak up and demand change.
