ASA ACTION: New Election for Medical Marijuana Measure

Three years after election officials said a local medical marijuana measure narrowly failed, a judge has ordered a new election. At issue are electronic voting machines that election officials did not properly maintain to ensure data was available for the recount requested by Americans for Safe Access. Whatever the outcome of the new election, ASA has won a victory for the democratic process.

An Alameda County judge has voided election results for a failed 2004 Berkeley medical marijuana measure, ordering it returned to the ballot next year because county election officials failed to hand over data from voting machines, attorneys in the case said Thursday.

A judge has nullified the results of a Berkeley medical marijuana ballot measure in 2004 because of what she said was misconduct by Alameda County election officials. Smith also ordered that the county refund $22,000 that Americans for Safe Access had to pay for a recount of the election results as well as some legal fees for the group's lawyers.


FEDERAL: Raid on Maker of Medicinal Edibles

DEA agents staged another paramilitary-style raid in Northern California, kicking down doors at locations allegedly related to a maker of medicinal edibles, arresting three people, and even killing an employee’s dog. Despite hysterical language from the DEA about mistaking the edibles for regular candy, all the products in question are clearly labeled as medicinal and are available only to qualified patients in dispensary settings. Like the other raids around the state, the DEA appears intent on disrupting patient access as much as possible before the next election cycle. Federal agents said Thursday they shut down a factory that made marijuana-laced barbecue sauce, chocolate-covered pretzels and other "enhanced" snacks intended for medical users of the drug.

NEW MEXICO: New State Law Close to Implementation

Thanks to the intervention of Governor and Presidential-candidate Bill Richardson, patients in New Mexico are now being afforded a measure of protection. The state may be the first to provide medical marijuana directly to patients, though the state attorney general has expressed concerns about the federal government going after state employees who are implementing the law.

FEDERAL: Dispensary Landlords Threatened in Santa Barbara

One of the latest tactics being used by the DEA to thwart patient access in California is the intimidation of the landlords whose buildings dispensaries are renting. The DEA has been sending letters to the landlords, telling them that the government may seize their buildings, even if they have nothing to do with the operation of the dispensaries. After the DEA raided the Los Angeles Cannabis Resource Center in West Hollywood several years ago, they even used asset forfeiture to seize the building the city had provided for the collective’s use.

The Sentencing Project: Disenfranchisement News & Updates - 9/27/07

Florida: Despite Landmark Move, Coalition Challenges Limitations of Re-enfranchisement Policy The Florida Rights Restoration Coalition (FRRC), a coalition of over 40 local, state and national organizations dedicated to eradicating Florida's antiquated and discriminatory voting rights ban, has submitted a memo to the U.S. Commission on Civil Rights to propose changes to the state's disenfranchisement policy enacted in April by the Clemency Board. The coalition proposes that the state adopt a "truly automatic, paperwork-free, rights restoration process for all Floridians who have completed their sentences, with any restitution owed to be paid, but not as a precondition to rights restoration." The current policy lifts the voting ban for non-violent offenders who have completed parole and probation and have paid restitution, but individuals must wait for the Clemency Board to restore their rights - a major obstacle according to the coalition. It also stated that the new rules pose several re-entry problems, including: -Burden on individuals who have been released and completed supervision -Needlessly complex and unclear restoration rules which lead to the poor administration of voting rolls -Bureaucratic delays in processing cases National: Jena Six Case, Disenfranchisement, Examples of Nation's Racial Disparity "The state laws are so varied that from jurisdiction to jurisdiction there is no consistency on what convictions will trigger a loss of voting rights," writes Dr. Henrie M. Treadwell, director of Community Voices in a column featured on BlackNews.com. Dr. Treadwell writes of the discrepancy and racial impacts of disenfranchisement and calls for action on the part of individuals nationally. "The burden falls upon communities to push their local legislators to advocate for reinstating voting rights to prisoners and those formerly incarcerated, especially the non-violent offenders." Theodore Shaw, Director-Counsel and President of the NAACP Legal Defense and Educational Fund, links racial disparities within the criminal justice system to the disenfranchisement of formerly incarcerated individuals and the Jena, LA., case in an interview published in the Oberlin Review. "[The Jena Six] is an example of the fact that racial disparities and discrimination are alive and well. While [it] is an important case, it is emblematic of a larger pattern of treatment of disparate ways of black and brown people that exist around this country ... Issues like felon disenfranchisement continue to bedevil us and will continue to bedevil us," he stated. International: High Court's Reasons Reveal 'Inconsistencies' in Constitution In August, the Australian High Court struck down a blanket ban denying all incarcerated individuals the right to vote, finding that the legislation was unlawful and unconstitutional. The Court's reasons in Roach vs. Electoral Commission and Commonwealth of Australia held that the 2006 amendments to the law were inconsistent with the system of representative democracy established by the Constitution. From 1902 to 1983, legislation banned certain prisoners from voting. Afterward, individuals sentenced for an offence punishable by imprisonment for one year were banned. FEDERAL: Judge Says Patient Must Return to Prison

A California medical marijuana patient is being sent back to jail to finish a 10-year sentence. Shortly after voters legalized medical use in the state, Bryan Epis began cultivating marijuana for himself and a handful of other qualified patients. Federal prosecutors claimed he was a drug dealer hoping to get rich; defense attorneys say they lied and misrepresented evidence at trial. Epis was released from prison after the Ninth Circuit Court of Appeals found in favor of medical marijuana patients in the Raich case, but now a judge says he has to go back and serve his original term.

For the second time in five years, Bryan James Epis, the first person associated with a California cannabis buyers' club to be tried in a federal court for growing marijuana, was sentenced Friday in Sacramento to 10 years in prison.


WISCONSIN: State Measure Introduced Again

For the fifth year in a row, the Wisconsin state legislature is taking up the question of whether medical marijuana patients should be prosecuted for following their doctors’ advice. Polling shows that more than 75% of Wisconsin voters think access to medical marijuana should be legal. Lawmakers will again have the chance to bring public policy into line with public opinion.

NEW YORK: Medical Marijuana Bill Moving Forward

The state Assembly has already passed a bill to remove criminal penalties for medical marijuana patients in New York. Now the state Senate is considering a different version of the bill, one that could render the law unworkable. The tactic has drawn the condemnation of at least one editorial board.

Wisconsin: Bill Proposes Voting While on Parole, Professor Shares His Story of "Civic Redemption," Importance of Voting Six Wisconsin residents would not be facing prison time if a bill introduced by Rep. Joe Parisi is passed by the legislature. Those citizens, who claimed they didn't know they were violating state law by voting while on parole, may return to prison - this time on voting fraud charges, according to a Wisconsin Public Radio report. Current state law bans parolees from voting. "They weren't out slashing tires, they weren't out holding up a convenience store. They were voting," said Parisi. "If our goal is to get people who have served their time in prison reintegrated back into society and to become productive members of society, a policy like this simply makes no sense." Having completed his sentence and parole, a Wisconsin professor voted for the first time in 2005 after having completed his five-year sentence. Kurt Hohenstein, who was charged with embezzlement, recently told his story of "civic redemption" at a public lecture at Winona State University where he teaches history, the Winona Daily News reported. After his release, Hohenstein, who lectures on the importance of democracy and voting, earned a PhD in history from the University of Virginia and won the Hughes-Gossett award from the Supreme Court Historical Society for his article on federal regulation of medical practice. National: Disenfranchisement Laws Produce "Invisible" Men, Women S. David Mitchell, law professor at the University of Missouri-Columbia School of Law, wrote a guest column for Jurist on the deprivations associated with felon exclusion laws. "When ex-felons are denied the right to vote, they are effectively silenced at the ballot box and are unable to choose political representation. ... While the laws have a direct impact on the lives of individual ex-felons, the laws collaterally impact the communities of which ex- felons are members." Mitchell advocates for the automatic restoration of rights upon sentence completion.

ASA ACTION: Defense of Patient Collectives Advances

Butte County, California has tried to limit patients’ ability to organize as collectives, but ASA is fighting that in court, arguing that county policy does not conform with state law. A win for patients would mean that the most seriously ill would have better access, since the policy being challenged prevents those who cannot actively participate in a growing collective from receiving medicine from it.

A Superior Court judge has ruled law enforcement response toward medical marijuana co-operatives or collectives in Butte County is out of step with state law. Joe Elford, chief counsel for Americans for Safe Access, the medical marijuana advocacy group that filed the lawsuit, cheered the pretrial ruling.


DISPENSARIES: Kern and San Mateo Counties Hear from Patients

Recent federal raids in both Kern and San Mateo counties have created a crisis of access for many patients in those communities. Local officials are being asked to stand up for their constituents and find ways to ensure the safe access that state law says is a patient’s right. ASA activists in San Mateo were instrumental in getting their local representatives to look at the issue, calling council members and supervisors, sending hundreds of e-mails, and organizing activists to testify at meetings.

CALIFORNIA: Collective Garden Uprooted, Patient Protests

At least one patient has stepped forward to publicly protest the destruction of a cannabis garden in Northern California, saying six of the 100 plants were his. Under state guidelines, all counties must allow any qualified medical marijuana patient to cultivate at least six mature plants. Many patients band together to grow their medicine at common locations for better management of the plants.

ILLINOIS: Senator’s Support for Medical Marijuana Lacks Action

When Illinois Senator Richard Durbin, who holds the key leadership position of Assistant Majority Leader, stated his support for legal access to medical marijuana, many patients and advocates took heart. But at least one editorial board wondered why Congress continues to authorize raids on medical marijuana patients and those who care and provide for them.

In an interview with the Associated Press last week, Illinois Senator Dick Durbin came out in favor of changing federal law to allow physicians to prescribe medicinal marijuana to their patients. Rhode Island's new state law, called the Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act, allows patients with debilitating medical conditions, such as cancer, HIV and multiple sclerosis, to possess up to 12 marijuana plants and 2.5 ounces of marijuana. As of early last month, 302 patients and 316 caregivers were enrolled in the program, according to the state Department of Health. A total of 149 physicians in Rhode Island have referred patients to the program.

When undercover federal agents were turned away from a California medical marijuana dispensary because they did not have valid doctors’ recommendations, the DEA fabricated identities and medical conditions for them, so they could trick a local cannabis specialist into giving them recommendations the dispensary could verify. When the DEA then raided the dispensary and the doctor discovered that he’d been duped, he filed suit, alleging the government had violated the US Supreme Court’s Conant decision, which protects doctors who recommend cannabis from federal interference.

U.S. District Judge Lawrence K. Karlton has denied the Drug Enforcement Administration's motion to dismiss a civil suit brought by Philip A. Denney, MD. The case will be tried in June 2008 in Sacramento. Denney is seeking to enjoin government agents from infiltrating a medical practice under false pretenses.


CALIFORNIA: Another County Implements ID Cards

In 2003, the California legislature directed county health departments to provide medical marijuana patients who want them with ID cards that both protect them from arrest and allow law enforcement to better identify qualified patients. But there was no deadline for when the ID cards should be made available, so some counties have been slower than others to get with the program.

CANADA: Health Officials Try to Limit Doses

Doctors and medical marijuana patients in Canada are under pressure from federal officials to limit the amounts being prescribed and used. One patient notes that officials never asked about her prescriptions for heroin or cocaine they way they are going after her cannabis use.

Florida: Restoration of Rights Gains State-wide Support
 
About a thousand Florida residents attended a Restoration of Rights and Redemption Summit last week to obtain support to have their civil rights restored. The Miami Herald reported that the effort was led by the local American Civil Liberties Union and Legal Aid in response to the Clemency Board's April vote to make it easier for most people convicted of nonviolent felonies to have their civil rights - which include voting - restored. Sen. Frederica Wilson, D-Miami, had $50,000 inserted in the state budget to help finance the summit and pay for a promotion campaign. Of the 38,000 individuals eligible for rights restoration at the time the rule was changed, nearly 14,000 have regained their rights.
Massachusetts: District Court Rules in Felony Disenfranchisement Case
 
The U.S. District Court of Massachusetts has opened the way for a challenge to the state's disenfranchisement policy as a violation of the Voting Rights Act. On August 30, the Court issued a ruling in Simmons v. Galvin, a case challenging that state's disenfranchisement laws. The plaintiffs had argued that the state of Massachusetts incorrectly denied their right to vote in federal and state elections.

In its ruling, the Court denied the state's motion for a summary judgment on the plaintiff's claim that Massachusetts' disenfranchisement policy violated Section 2 of the Voting Rights Act. The plaintiffs had argued that the racially disproportionate impact of the state's felony disenfranchisement policy violated the Act. The Court ruled that "[i]t may be difficult for plaintiffs to prove that racial bias in the court system exists and has interacted with other cognizable factors to render" the Massachusetts policy unlawful, but they should be given the opportunity to make that case in court.

The Court rejected two additional arguments of the plaintiffs. First, the plaintiffs had contended that the change to the Massachusetts law in 2000 that denied the right to vote to persons who are currently incarcerated should not apply to them because they were incarcerated prior to the constitutional amendment that resulted in the policy change. They argued that to deny their right to vote was a violation of the Ex Post Facto Clause of the United States Constitution. The Court disagreed, ruling that the Ex Post Facto Clause does not apply to "civil, non- punitive measures" intended "for the regulation of the franchise." The Court held that the "amendment was intended to be primarily civil and regulatory, rather than punitive, in nature."

Secondly, the plaintiffs argued that Massachusetts' disenfranchisement policy violates the Equal Protection Clause of the 14th Amendment. In granting the state's motion for summary judgment, the Court pointed to the established ruling in Richardson v. Ramirez upholding the practice of felony disenfranchisement as clear evidence that the law in Massachusetts does not run afoul of the Constitution. - - - - - -
