Guatemalan Leader Wants Decriminalization Talks

Newly installed Guatemalan President Otto Perez Molina has called for talks about a regional drug strategy, including drug decriminalization. Perez Molina made the remarks in an interview with the Mexican TV network Televisa, Miami's El Nuevo Herald reported.

"I believe that the decriminalization of drugs would have to be a strategy in which all the region agreed," said the retired army general who took office January 14. "We're talking here from the south, where it is produced, through all the countries, like Guatemala, through which it passes, to Mexico and the United States. I think that if this is not the path, then when have to find another, but it has to be a regional strategy in which we are all disposed to make the same effort."

While praising Mexican President Felipe Calderon for making "a very great effort" in his fight against drug traffickers, Perez Molina complained that that effort "has not been matched by the United States, which is its neighbor and largest [drug] market."

Perez Molina's remarks on decriminalization come as something of a surprise. He said nothing like that during his election campaign, in which he vowed to use "an iron fist" against encroaching Mexican cartels. In one of his first acts in office, he emulated Calderon by calling out the armed forces to fight the cartels.

Both the Zetas and the Sinaloa cartel are reported to be operating in Guatemala, which borders Mexico to the north. The drug gangs are blamed for an increasing number of killings in the Central American country, the bloodiest being the May 2011 massacre of 27 farm workers whose boss had been targeted by the Zetas.

Chronicle Book Review: Drugs and Drug Policy

Drugs and Drug Policy: What Everyone Needs to Know, by Mark Kleiman, Jonathan Caulkins, and Angela Hawken (2011, Oxford University Press, 234 pp., $16.95 PB)

Mark Kleiman isn't real popular among the drug reform set. The UCLA professor of public policy is no legalizer, and even though he's too much of an evidence-minded academic to be a wild-eyed drug warrior, he still seems to have an unbecoming fondness for the coercive power of the state. Kleiman, who gets top-billing over coauthors Jonathan Caulkins of Carnegie Mellon and Angela Hawken at Pepperdine, also ruffles reformers' feathers with unnecessary snideness and snark.

But I watched Kleiman address Students for Sensible Drug Policy conventions a couple of times, and I thought it was a good thing, a very useful jolt to the group-think that can grip any gathering of congregants committed to a cause. I thought having the students have to hear the arguments of a leading academic thinker on drug policy who, while not "the enemy," was not especially saying what the average SSDPer wanted to hear, was salubrious for their critical thinking skills. I still think so.

In Drugs and Drug Policy, Kleiman and his coauthors continue with the occasional jibes aimed at the drug reform movement, at times reach conclusions at odds with my own, but also serve up a surprisingly chewy work of drug policy wonkery in delicious bite-size chunks. The innovative format, something like a series of FAQs organized within broader chapters -- "Why Have Drug Laws?" "How Does Drug Law Enforcement Work?" "What Treats Drug Abuse?" "Can Problem Drugs Be Dealt With at the Source?" -- allows us to unpack that all-encompassing monster called "drug policy" one subset at a time, and for that achievement alone, is worthy of praise. That it manages to cover so much ground in a paltry 234 pages is all the more laudable.

Overall, Drugs and Drug Policy is smart, reasonable, and thoughtful. It wants policies based on evidence and it advocates for some intelligent alternatives to current policies. It recognizes the utility of needle exchanges, safe injection sites, and opiate maintenance, even as it complains that "harm reduction" has been hijacked by legalizers. It explains that most people who use drugs -- even those diagnosable as suffering from substance abuse disorders -- will quit using drugs themselves without recourse to treatment. And it even allows that drug use can have beneficial effects, even if it doesn't do so until the seventh chapter.

But Kleiman et. al dismiss decriminalization as unlikely to have a big impact on the social fiscal burden of drug law enforcement because, even though it doesn't appear to have much impact on consumption, drug consumers are not, for the most part, filling our prisons -- drug dealers are. While they do concede that not criminalizing otherwise law-abiding citizens could have "significant benefits," they seem to underplay the negative, life-long impact of a criminal drug record on one's life prospects.

In fact, they seem all too comfortable with maintaining the pernicious role of the criminal justice system in drug policy even as they recognize that enforcing the drug laws is "unavoidably an ugly process," with its reliance on snitches, surveillance, and other "intrusive methods" of enforcement. To give them credit, they want smarter drug law enforcement -- concentrating police repression on violent drug dealers while turning a blind eye to discreet dealing, triaging coerced drug treatment spots so they are reserved for the people who could most benefit from them, giving up on interdiction and source country eradication as ineffective -- that might actually reduce the social and fiscal costs of both drug abuse and enforcement, and since drug prohibition isn't going away anytime soon, at least wasting less money on drug war tactics that don't work well should be on the table.

And they reject drug legalization as too scary to experiment with, but seem to imagine it as possible only within a corporate-controlled, heavily-advertised, low-priced scenario similar to that which has accreted around the alcohol industry. Yes, it's probably true that selling cocaine like Coors, would lead (at least initially) to a significant increase in use and problem use, but why does that have to be the only model? A government monopoly similar to the state liquor store model, with reasonable taxes and no corporate pressure to advertise could conceivably allow legalization without the increases in consumption that the authors predict, even though they concede they don't know how large they might be.

Still, when you get to what it is Kleiman et al. would do if they had their druthers, all but the most purist of legalization advocates will find a lot to like. They create three separate lists of recommendations -- a "consensus list" of reforms they think are politically doable now or in the near future, a "pragmatic list" of reforms that would appeal to dispassionate observers but could raise the hackles of moralists, and a "political bridge too far list" of reforms too radical for mainstream politicians to embrace.

The "consensus list" includes expanding opiate maintenance therapy, encouraging evidence-based treatment, early intervention by the health care system, encouraging people to quit on their own (as opposed to being "powerless"), relying less on interdiction, ending the charade that alternative development is drug control, and concentrating drug enforcement on reducing violence and disorder, as well as smarter, more effective coerced treatment in the legal system. If we saw the drug czar's office produce a National Drug Control Strategy with these recommendations, we would consider that a great victory. It ain't legalization, but its headed in a more intelligent, more humane direction.

The "pragmatic list" includes recommendations to lower the number of drug dealers behind bars, not reject harm reduction even if it's been "hijacked," stop punishing former dealers and addicts, reduce barriers to medical research on illegal substances, and be open-minded about less harmful forms of tobacco use.

The authors don't neglect alcohol and tobacco -- the two most widely-used drugs -- and that is really evident in their "political bridge too far" recommendations. The first three items there are aimed squarely at reducing alcohol consumption and its ill effects. They also argue for the legalization of individual or collective marijuana cultivation, a sort of legalization without the market, increased study of the non-medical benefits of drugs, and increasing cigarette taxes in low tax states.

I think Drugs and Drug Policy needs to be read by anyone seriously interested in drug policy reform. It hits almost all the bases, and it's well-informed, provocative, and challenging of dogmatic positions. You don't like the authors' conclusions? Refute them. It'll be good for you.

Drug trafficking organizations have muscled their way into Central America, opening a new chapter in the drug prohibition war that almost certainly will exact further cost on U.S. taxpayers as American authorities confront these organizations on a new frontier. The extent of the infiltration is breathtaking. Drug trafficking organizations now control large parts of the countries of Honduras, El Salvador and Guatemala, the so-called Northern Triangle of Central America. They've bought off politicians and police, moved cocaine processing laboratories up from the Andes, and are obtaining rockets and other heavy armament that make them more than a match for Central America's weak militaries.

Venezuelan Drug Trafficker, Walid Makled, Says Chávez Government Officials Tied to Cocaine Trade

He says that five or six plane-loads of cocaine take off everyday from San Fernandeo de Apure, in south-western Venezuela, bound for the US, via Honduras and Mexico. "It’s an everyday thing. Not every other day, it’s every day. Between FARC and the Venezuelan Army, we’re talking about four or five planes leaving Apure every day."

Authorities in Awe of Drug Trafficking Organizations' Jungle-Built, Kevlar-Coated Supersubs

For decades, Colombian drug trafficking organization have pursued their trade with amazingly professional ingenuity, staying a step ahead of authorities by coming up with one innovation after another. When false-paneled pickups and tractor-trailers began drawing suspicion at US checkpoints, the traffickers and their Mexican partners built air-conditioned tunnels under the border. When border agents started rounding up too many human mules, one group of Colombian smugglers surgically implanted heroin into purebred puppies. But the drug runners’ most persistently effective method has also been one of the crudest — semi-submersible vessels that cruise or are towed just below the ocean’s surface and can hold a ton or more of cocaine.

How Afghan Poppy Eradication Efforts Are Helping the World's Largest Heroin Dealers

Colombia's FARC May Inherit Hundreds of Men from Slain Drug Lord

Colombia's largest rebel group FARC may benefit from the recent killing of neo-paramilitary drug lord "Cuchillo," newspaper El Espectador reports. According to the newspaper, the death of Pedro Oliveiro Guerrero, alias Cuchillo, late last month brought an end to the paramilitary rule of the underworld of Colombia's eastern plains that started when the AUC took control of the region in the 1990s. A police investigator told El Espectador that members of Cuchillo's organization ERPAC have been meeting to assure a continuation of the drug trade, but have not been able to appoint a successor of their slain leader.

Drugs Are a Development Issue - Which is Why We Should Legalize Them (Opinion)

Flood of Drugs from Myanmar: Is War Brewing?

In the lead-up to Myanmar's first elections in two decades the flow of drugs from the country has become a flood as drug-producing rebels prepare for a showdown with the junta, experts say. Thailand has seen the amount of illicit drugs seized surge this year and observers say nervousness about a possible military crackdown in Myanmar on armed minorities could be fueling the increase. Thailand-based Saw David Taw of the Ethnic Nationalities Council - a coalition of Myanmar ethnic groups - said there was "a rumour going around that people are preparing for war".

Mexican President Calls for Drug Legalization Debate

After presiding for years over the bloodiest drug war escalation in history, Mexican President Felipe Calderon is finally ready to discuss legalization.

MEXICO CITY — President Felipe Calderon said he would consider a debate on legalizing drugs Tuesday as his government announced that more than 28,000 people have been killed in drug violence since he launched a crackdown against cartels in 2006.

"It's a fundamental debate in which I think, first of all, you must allow a democratic plurality (of opinions)," he said. "You have to analyze carefully the pros and cons and the key arguments on both sides." [AP]

It's just an earth-shattering concession from the man who staked his presidency on a desperate attempt to prove that aggressive enforcement could somehow restore peace and order. Now, with the streets stained in blood and corruption permeating the highest levels of government, Calderon appears poised to confront the crushing reality that there's just no upside to any of this. He needs room to maneuver, and after exhausting every traditional tactic in the drug prohibition playbook, there remains only one conversation left to be had.

Of course, Calderon was careful to clarify that he's acknowledging, rather than endorsing, the legalization argument:

But Calderon has long said he is opposed to the idea, and his office issued a statement hours after the meeting saying that while the president was open to debate on the issue, he remains "against the legalization of drugs."
 

Riiiight. He's a politician and surely realizes that paying lip service to a touchy subject like this serves only to give it momentum. Posturing aside, Calderon knows exactly what happens when you open this door. He can see it already in the American press, and I can only imagine that he's now perfectly willing to witness the emergence of a sizable movement for reform in Mexico. If he weren't, you can bet he'd never dare drop the "L" word with a microphone at his mouth.

Whether he intended to or not, Calderon has spent his presidency performing the most compelling imaginable exhibit in the failure of prohibition. After sacrificing so much, his only chance at redemption may depend on his willingness to take the lead in learning something from the smoldering nightmare that now surrounds him.
